How-ie About Skipping Jury Duty?



Feel like bagging
jury duty? Simply tell them you're a talk radio fan!

Howie Carr's recent column on how his name is being used to weed out "biased" jurors in New Hampshire (read: pro-punishment for criminals) had me chuckling.

Here's an even better way out: have a history of hosting talk shows, an even more heinous crime from the perspective of the Bay State's wacky court system.

Two weeks ago, yours truly had jury duty in the lovely metropolis of Brockton, absolutely nowhere near where I actually live.

Having not a clue where to go, I reported to the sparkling new mega-courthouse in Brockton's city center, which looks like a fancy hotel or upscale corporate office building amid the ruins of what was probably once a decent downtown area. Sure enough, I was actually assigned to the Superior Court building down the street, which is a smelly, dirty, crumbling dump.

That's where I had one of those my-God-what-am-I-doing-in-Massachusetts moments: prospective jurors were compelled to watch an introductory video featuring a sermon by Margaret Marshall, of our rogue Supreme Judicial Court.

With her odd, Barney Frank-meets-the-Kennedys manner of speaking, it was especially difficult to watch a reckless justice lecture us about the "rule of law" in a state where that concept exists only in theory.

Did the other hundred or so prospective jurors understand this as well, or were they indoctrinated into this absurd mindset decades ago? I ask myself that same question whenever I visit the RMV or another government office.


I came within a hair of being seated on a jury considering the fate of a young man who is accused of raping a mentally-retarded girl he met over the Internet. The crime occurred more than three years ago.

But let's face it, with a background in talk radio, there's simply no way the defense would have allowed me to be seated. Howie's right: that's one of the quickest ways to be sent home.

Could I have been fair and impartial? Of course. I don't know this guy or the victim and there's no way I could come to a conclusion about his guilt without prosecutors proving their case.

In fact, I'm inclined to believe talk radio listeners are more capable of being fair than the general population at large. They're certainly smarter and better informed.

But it will be a cold day in Hell before defense attorneys allow any of us to be seated inside that box.

They run every single institution in this state. Brockton is a shining example of how well their social programs (funded by our tax dollars) and government "for the people" are working. There IS such a thing as an inbred mentality, and Democrats perfect specimens. They're all nuts (with a straight face)...and afraid of anyone who's figured them out. They also believe we're ALL stupid. Maybe we are, since we simply are not able to vote them out.

Brian, that is interesting. Such bias in the jury pool system, for sure.

In any event, we do not need people of any particular political persuasion or IQ on the jury. Just people who can think and reason for themselves. I always think back to that classic All in the Family episode in which Edith served on the jury... hilarious. And not far off, I'll warrant.

Look, I am a Howie Fan and a conservative, but you're really missing the point on this.

The defense attorneys are trying to eliminate people who have heard too much about the case in the media and might have some pre-conceived notions about the guilt or innocence of the defendant based on what they heard. Howie has done a lot of segments on "Stix" and lots of people have called in frothing at the mouth calling for his lynching (only a slight exaggeration).

The less a potential juror has heard about the case before the trial, the more likely they are to render a fair and impartial decision. Most Howie listeners might be fair and impartial, but based on those segments, as an attorney, I would not want any juror on the panel who might have heard them with my client facing the death penalty. You just can't afford to take the risk.

This is not a liberal or conservative issue. So don't paint it in those terms. I thought you were smarter than this.

Lastly, in the interest of the thread I must admit that I have never, ever served on a jury. I have been called several times. Always a bridesmaid, I guess!

Tom G, point well taken. But I retract none of my statement regarding the liberal left or the culture of corruption brought on by the Democrats in this state. I'm with Howie all the way on those points. Unions, judges, pols, hacks, "in the tank" media...they've mobbed up the whole system so that it would take a monumental effort to sweep them out.

the name-calling; the talking over callers; the frequent soliloquies; the swallowing and breathing into the mic; the repeated references to little Reagan, et. al; the constant use of pet phrases like 'and the like' and 'any number of' and 'part and parcel'; the annoying laugh; the double entendres; etc.

I agree with your point that the defense attorney is only doing what any good attorney should do (and by law, ought to do), and that is to jealously defend their client.

With that being said, do any of us want to be tried before a jury that is so out of touch that they know NOTHING of current events? If you live in Manchester as I do and you can honestly answer during jury selection that you have either no knowledge of the alleged circumstances of this case or have not heard enough information to have formed an opinion on this case, then you are a buffoon who lives under a rock. In order for either of those statements to be true, you would have had to have been in a deep coma for almost 2 years.

The lawyers for O.J. Simpson (brilliant attorneys to be sure) used the tactic of having the case heard in downtown Los Angeles for the sole reason that the vast majority of downtown residents (from which the jurors were chosen) were black. The case could have (and should have) been tried in the predominately white suburb of Brentwood - where the crime took place. They knew that they were much more likely to find a jury pool of residents who were sympathetic to their contentions of a vast racist conspiracy by the LAPD and the crime lab to frame an innocent black man who had the temerity to marry a white woman. They were correct. The follow-on civil trial was held in the white suburb of Simi Valley and that jury found Simpson liable for the killings so there is something to be said for the tactic of venue change.

I suppose Addison's lawyers are trying to figure out a way to find the most jurors who are potentially sympathetic to their side (as they should) but to bring in radio listening habits as a disqualifying factor is a bit of a reach. What is really going on here (in my opinion) is the search for a Liberal jury. These attorneys know good and well that NH is 97% white and about 0.7% black. If they can find jurors who believe that NH is fundamentally unwelcoming to black people (and only Liberals would believe that) they might have a chance to save this guy's neck.

My prediction: Right before the trial is to begin (after all venue change arguments and capital punishment validity arguments have been exhausted), Addison will plead guilty to 1st degree murder with the provision that he be spared the death penalty. The state will accept this in an effort to put this case to bed and to save the cost of a long trial and appeals process. It also doesn't hurt Addison that the statehouse is currently controlled by Liberals and Gov. Lynch (pun intended)and his Democrat allies would like to avoid having to be anywhere near a death warrant.
